Adaptive defrost failed "out of the box".

We got this fridge with our brand new apartment. In the first week it lost control of the main box temperature three times. The freezer was still cold. The maintenance tech had use thaw the entire unit three times and set the temperatures for 44 and 4. It's still not working and they refuse to consider the obvious: the defrost system isn't working. I'm just supposed to keep thawing it out every day or two and throw my food away if I don't catch it before it hit 60 inside.
